Supreme Court Criticizes RERA, Permits Himachal Pradesh Office Shift

The India===Supreme Court of India expressed profound disappointment with the India===Real Estate Regulatory Authority (RERA), questioning its effectiveness and suggesting its abolition if it continues to primarily benefit builders rather than homebuyers. A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi noted that RERA was failing its intended purpose of regulating the real estate sector, enhancing transparency, and protecting homebuyers. The remarks were made during an appeal against a India===Himachal Pradesh High Court order that had stayed a state government notification to shift the India===Himachal Pradesh RERA office from Shimla to Dharamshala. The India===Supreme Court of India subsequently set aside the High Court's stay order, permitting the India===Himachal Pradesh government to proceed with the office relocation and directing the principal appellate tribunal to also move to Dharamshala to avoid inconveniencing affected individuals.
