The market is likely to react positively to InterDigital, as the injunction strengthens its intellectual property rights and validates its licensing model, potentially leading to increased revenue. For Transsion, the inability to sell 5G devices in Brazil will negatively impact its market position and sales in the region.
InterDigital, a wireless, video, and AI technology research and development company, has been awarded a preliminary injunction against Transsion by the 3rd Regional Business Court of Rio de Janeiro in Brazil. The court ruled that Transsion infringed two of InterDigital's 5G patents and found InterDigital's licensing offer to be fair, reasonable, and non-discriminatory (FRAND). As a result, Transsion is now prevented from selling 5G-compliant devices in Brazil. This decision follows an independent expert report that supported InterDigital's claims of infringement and the essentiality of its patents to 5G technology. Josh Schmidt, Chief Legal Officer at InterDigital, emphasized that Transsion should pay fair value for the technology it uses.
